Planning

Under the Planning Act the City is required to create and implement its own policies related to planning, and such policies must be consistent with the Planning Act and Provincial Policy Statement. An Official Plan is a document that sets out the City's vision for development for the 20-year planning horizon. The Official Plan directs where housing, industries, and commercial businesses can locate and sets out policies for the protection and preservation of farmland, the natural environment, and natural resources. The Official Plan also sets out the policies and considerations for new development, such as the requirements for certain studies, infrastructure, and other related considerations.

An Official Plan Amendment is required when the proposed development cannot meet the requirements of the Official Plan, or a development is being proposed in a designation where it is not permitted. Consultation with the Planning Department is required prior to applying for an Official Plan Amendment.

A Zoning By-law is a regulatory document that implements the policies of the Official Plan. The Zoning By-law sets out specific requirements for development on properties located within different zones. The Zoning By-law states which uses and buildings/structures may be permitted on a property, as well as where on a property such uses, buildings, and structures may be located.

A minor variance is required when a building or structure will vary slightly from the provisions of the Zoning By-law. A minor variance is a minor amendment to the Zoning By-law and is always specific to a particular property and building. A minor variance is also required for the expansion of a legal non-conforming use. Minor variance applications are handled by the City's Committee of Adjustment. Consultation with the Planning Department is required prior to applying for a minor variance.

Consent to sever is required when an interest in land is being conveyed to another person. A consent to sever application is required for a lot severance (creation of 1 or more new lots), a lot addition, a boundary adjustment, a right-of-way, or an easement. Applications for consent to sever are handled by the City's Committee of Adjustment. Consultation with the Planning Department is required prior to applying for a consent to sever.

A plan of subdivision may be required when land is being divided into more than four new lots, or when the extension of municipal services and/or roadways is required. Consultation with the Planning Department is required prior to applying for approval of a plan of subdivision.

A condominium is a form of ownership in which individuals have ownership of their own units and share the ownership of common elements (eg. parking areas, private roads, elevators, lobbies, open space, etc). A plan of condominium is required when this type of ownership structures is proposed. Consultation with the Planning Department is required prior to applying for approval of a plan of condominium.

Site Plan Control is an agreement between the City and the property owner regarding the development of the site such as lighting, landscaping, walkways, parking, lot grading and many other site related items. Site Plan Control is typically required for the development and redevelopment of commercial, industrial, and institutional properties, but may also apply to residential properties in certain circumstances. Consultation with the Planning Department is required prior to applying for Site Plan Control.

The Committee of Adjustment of the City of Temiskaming Shores makes decisions on applications for Minor Variances and Consent to Sever. The Committee of Adjustment generally meets the last Wednesday of every month.
